Cancel, suspend or limit access to your Account or the Actnet Payment E Innovacion Argentina SA;

Suspend your right to participate in the Actnet Payment E Innovacion Argentina SA Purchase Protection programs / or the Actnet Payment E Innovacion Argentina SA Seller Protection Actnet Payment E Innovacion Argentina SA;

Refuse to provide the Services offered by Actnet Payment E Innovacion Argentina SA now and in the future; and

Retain your funds for a while reasonably necessary to protect us against the risk of liability to Actnet Payment E Innovacion Argentina SA or a third party or if we believe that you may be involved in potentially suspicious or fraudulent activities or transactions.

I RETENTIONS

Withholdings Based on Risk.

Actnet Payment E Innovacion Argentina SA, in its sole discretion, may place a hold on any or each of the payments you receive if Actnet Payment E Innovacion Argentina SA believes that there may be a high level of risk associated with you, your account, or any and all of your transactions. Actnet Payment E Innovacion Argentina SA’s decision may be based on different factors, and it may depend on the information it receives from third parties. If Actnet Payment E Innovacion Argentina SA places a hold on a payment, the funds will appear in your “outstanding balance,” and the payment status will indicate the delay. For example, it may seem as “Done, funds not yet available.” If Actnet Payment E Innovacion Argentina SA places a hold on some or all payments you receive, Actnet Payment E Innovacion Argentina SA will notify you of our actions. Actnet Payment E Innovacion Argentina SA will release the hold on any price after 30 calendar days from the date you received the payment in your Account unless Actnet Payment E Innovacion Argentina SA has a reason to continue holding the cost, such as (a) having received a Dispute, Claim, Chargeback or Cancellation, (b) Actnet Payment E Innovacion Argentina SA believes that you have violated the terms of this Agreement or any other Policy and that such violation has resulted in the need to continue to hold funds or, (c) Actnet Payment E Innovacion Argentina SA believes that you may be involved in potentially fraudulent or suspicious transactions or activities. In such cases, Actnet Payment E Innovacion Argentina SA may continue to hold the payment in your Account until the problem is resolved under this Agreement. Actnet Payment E Innovacion Argentina SA, in its sole discretion, may release the hold earlier under certain circumstances, such as if you uploaded the tracking information for the item you shipped.

b: Withholdings of transactions in Controversy.

Suppose a User presents a Dispute, Claim, Chargeback, or Reversals for a payment you have received in your Account. In that case, Actnet Payment E Innovacion Argentina SA may temporarily retain the funds in your Account to cover the respective liability amount. If you win the dispute or the transaction qualifies for Actnet Payment E Innovacion Argentina SA Seller Protection, we will remove the temporary hold. If you lose the Dispute, Actnet Payment E Innovacion Argentina SA will terminate your Account’s funds. This process will also apply to any claim that a buyer submits directly to Actnet Payment E Innovacion Argentina SA through the Actnet Payment E Innovacion Argentina SA Money-Back Guarantee program, provided that your Account has been determined as the method of reimbursement for amounts owed to Actnet Payment E Innovacion Argentina SA or the buyer. In that case, the transactions will appear as “pending” in your Actnet Payment E Innovacion Argentina SA balance, and you will not have access to the funds that are in “pending” status until they are cleared. If your Account is subject to a Reservation, Actnet Payment E Innovacion Argentina SA will provide you with a notification specifying the reservation terms. The terms may require that a certain percentage of the amounts you receive in your Account be held for a specific time or that a certain amount of money be held in the Reserve or any other measure that Actnet Payment E Innovacion Argentina SA determines as necessary to protect the risk associated with your Bill. Account closure, service cancellation, restricted access to the Account; confidential criteria.

Actnet Payment E Innovacion Argentina SA, at its sole discretion, reserves the right to terminate this Agreement and/or access to the Services offered by Actnet Payment E Innovacion Argentina SA for any reason and at any time after having notified you, having made the payment of any funds in your Balance that are not limited; the preceding, without liability for Actnet Payment E Innovacion Argentina SA and the need for a prior judicial resolution. Suppose we restrict access to your Account, including through Reservations or holds. In that case, we will notify our actions and the opportunity to request reinstatement of a permit if we deem it appropriate at our sole discretion. TRANSLATED AGREEMENT.

Any translation of this Agreement is provided solely for your convenience and is not intended to modify this Agreement’s terms. In the event of a conflict between the English version of this Agreement and the language version other than English, the English version will control.

DOES NOT WAIVE

Our omission or delay in the exercise of the corresponding actions in the event of a breach by you or by others will not mean a waiver of our right to exercise such efforts concerning such breach or a subsequent or similar breach.

SUBROGATION OF RIGHTS

Suppose Actnet Payment E Innovacion Argentina SA pays a Claim, Reversal, or Chargeback that You have filed against a recipient of your payment. In that case, you agree that Actnet Payment E Innovacion Argentina SA will subrogate its rights against the recipient and third parties about the price and that you exercise those rights directly or on your behalf, at the discretion of Actnet Payment E Innovacion Argentina SA.
